TERMS OF USE

1. Definition of concepts

In the text of this User Agreement (hereinafter referred to as the “Agreement”), you will find the following terms:

"OnlySport" is a service where users can search, find, publish and watch videos and other content, as well as communicate with each other and share information and ideas. OnlySport also gives authors and advertisers the opportunity to publish and distribute videos and ads.

"Content" means all objects posted on OnlySport by Users, as well as by the Administration, including design elements, text, graphics, illustrations, videos, programs, music, sounds, information, notifications and any other objects of similar purpose, their collections or combinations. In other words, these are video, audio (musical works and other sounds), graphic materials, photographs, text (video comments and video or audio texts), branding elements (including brand names, trademarks, service marks and logos), interactive functions, software, indicators and other materials. provided by you, the Platform, or third parties. The Content can be provided and distributed by our Users in OnlySport, while OnlySport is a hosting service provider for such Content. The individual or legal entity who uploaded the Content to OnlySport is responsible for the Content.

A "User" is an individual who uses OnlySport and/or has gained access to its Content and has given his consent to comply with the OnlySport terms of use set out in the text of this Agreement.

An "Account" is personal information that a User voluntarily provides to the Onlysport Administration to store, process, and provide access to the User's personal data and settings. The user can use some OnlySport functions (search and view Content) without an account. However, an account is required to access more of OnlySport's features and Services.

"OnlySport Software" is software developed by the Administration (and/or third parties on behalf of the Administration) for OnlySport, including, but not limited to, all software, scripts, codes, programs, etc.

"Services" - the OnlySport service provider is the Administration, whose activities are carried out in accordance with the legislation of the Russian Federation.

"User Content“, ”Content" are all publications, as well as all active actions (activities) performed by the User on OnlySport, as well as any other content created by the User.

2. OnlySport Users

2.1. In order to use OnlySport, Users must meet the following criteria (collectively):

2.1.1. Be at least 13 years old;

2.1.2. Not to be restricted in the right of access to OnlySport, its Services and Content based on a court decision that has entered into force, or in cases provided for by applicable law or the terms of this Agreement.;

2.1.3. Comply with the following conditions:

• If you are under the age of 18, you must not use the Platform without the consent of your parents or guardian. Ask them to read this Agreement with you.
• if you are a parent or guardian of a User under the age of 18, then by allowing a child to use the Platform, you are obligated to comply with the terms of the Agreement and be responsible for the actions that your child performs on the Platform.

3. Register on OnlySport and create a personal Account. Personal Data Processing Policy

3.1. Registration and/or authorization of the User on OnlySport is free, voluntary, and implies acceptance of the Agreement, as well as the Privacy Policy, which is available at: https://onlysport.app/terms/privacy-policy .

3.2. An OnlySport User is an individual registered on OnlySport in accordance with the established rules of this Agreement, who has reached the age allowed in accordance with the legislation of the Russian Federation for acceptance of these Rules, and has the appropriate authority.

3.3. During the OnlySport registration process, the User undertakes to provide the OnlySport Administration with the necessary reliable and up-to-date information for the formation of the User's personal Account, including a unique username and password for each User to access the OnlySport Account, as well as the last name and first name. The OnlySport registration form may request additional information from the User at the discretion of the Administration. The Administration also draws attention to the fact that the User is responsible for the accuracy, topicality, completeness and compliance with the law of the information provided during registration and its purity from third-party claims.

3.4. The OnlySport registration process is as follows:

The user is also required to indicate their date of birth, as the service has content with age restrictions. This provision of the Agreement is a mandatory part of the User's consent to the fact that the Platform Administration is not responsible for incorrectly stated or deliberately false date of birth. The User grants the right to have his personal data processed by the Administration for the purposes specified in this Agreement.

3.5. During the registration process, the User agrees to the rules of this Agreement, the personal data processing policy, and assumes the rights and obligations specified therein related to the use and operation of the Platform. The User agrees to receive through the services of the Platform Administration and / or third-party services electronic messages and other types of newsletters of information, including advertising and informational content, including from partners of the Platform Administration.

3.6. The subsequent processing of the User's personal data is carried out in accordance with the legislation of the Russian Federation. The Platform Administration processes the User's personal data in order to provide the User with access to use the OnlySport functionality. The OnlySport Administration undertakes to take all necessary measures to protect the User's personal data from unauthorized access, modification, disclosure or destruction. The Administration provides access to the User's personal data only to those employees, contractors and agents of the Administration who need this information to ensure the stable functioning of the Platform and provide the User with access to its use. In addition, the OnlySport Administration has the right to use the information provided by the User, including personal data, as well as transfer it to third parties, in order to ensure compliance with the requirements of current legislation, protect the rights and interests of Users, the OnlySport Administration, and third parties (including for the purpose of identifying, verifying/investigating, and/or suppressing illegal actions). actions). Disclosure of the information provided by the User may be made only in accordance with applicable law at the request of the following authorities: courts, law enforcement agencies, as well as in other cases provided for by law.

3.7. The User has no right to transfer his login and password to third parties, bears full responsibility for their safety, independently choosing the method of their storage. The user can use the hardware and software to allow the storage of the login and password (using cookies) for subsequent automatic authorization on OnlySport.

3.8. If the User has not proven otherwise, any actions performed using his login and password are considered to have been performed by the corresponding User. In case of unauthorized access to the username and password and/ or the User's personal page, or the distribution of the username and password, the User is obliged to immediately inform the OnlySport Administration about this.

4. OnlySport Terms of Use

4.1. The User may access and use OnlySport provided that he complies with the requirements of the legislation and this Agreement. Watching and listening to the Content is allowed only for personal, non-commercial purposes.

4.2. Within the framework of this Agreement, we (the Administration) have developed certain restrictions on the use of OnlySport, which must be observed by each OnlySport User. Prohibited:

4.2.1. View, copy, download, distribute, transmit, broadcast, demonstrate, sell, license, modify, transform or in any way use the Content or any component of the Platform, except as specified below. To perform these actions, the following is required:: a) permission by the OnlySport rules; b) prior written permission from representatives of the Administration and, if necessary, the relevant copyright holders; c) permission in accordance with applicable law;

4.2.2. Circumvent restrictions, carry out fraudulent manipulations or otherwise interfere with the operation of OnlySport, including security-related functions, as well as functions that prevent or restrict the use or copying of any Content, as well as impose restrictions on the use of Content;

4.2.3. Exploit OnlySport using automated means such as botnets and content collectors.;

4.2.4. Collect and store on local repositories any information that can be used to identify an individual, such as the User's NAME or any other Account data. Such actions can only be performed with the written permission of this person.;

4.2.5. Use the services of persons who artificially increase the number of views, "Liked" marks, subscribers and other statistical indicators of channels and videos, as well as independently perform actions that prevent viewers from accurately measuring the actual interest in the Content.

4.2.6. Use OnlySport to distribute promotional and commercial materials without the consent of the Administration, as well as other undesirable materials, including those that impose something, such as spam. in order to distribute unsolicited materials of an advertising, commercial or other nature and other undesirable, intrusive materials, for example, spam;

4.2.7. Conduct contests, sweepstakes, and lotteries on OnlySport that contradict current legislation and this Agreement;

4.2.8. Any design of the user channel, as well as attempts to issue the channel under the official channel of the OnlySport video hosting, the OnlySport Administration, using the official logo, name, visual design identical to OnlySport, as well as the publication of content on the channel with materials containing news, events, other content posing as the official content of OnlySport, The Administration of OnlySport, in order to mislead the Users of the video hosting service and pass off their User Channel as the official channel of OnlySport, the Administration of OnlySport.

4.2.9. Use OnlySport to reproduce Content for any purpose other than personal and non-commercial purposes.

4.3. For violations of the OnlySport terms of use, the Administration has the right to delete the Account with the impossibility of further registration on OnlySport.

4.4. When using OnlySport, as well as its Services and Services, the User is also obliged to adhere to the following rules:

4.4.1. Comply with all obligations assumed by the User in connection with joining this Agreement;

4.4.2. Provide the Administration with reliable information during registration on OnlySport;

4.4.3. Not to impersonate another person, including, but not limited to, not to provide any data to third parties (without obtaining their direct, prior and informed consent) to register on OnlySport and/or to create an Account;

4.4.4. Inform the Administration about the leakage of usernames, passwords or any other User access keys to the Account, or the deliberate theft (hacking) of access to the Account;

4.4.5. Do not upload, store, publish, distribute, post, advertise, send, provide access to, or otherwise use Content that contains threats, discredits, insults, defames honor and dignity or business reputation, or violates the privacy of other Users or third parties, and is spam, bullying, vulgar or obscene, contains pornographic images and texts, obscene language, profanity, including profanity, written in the name of any kind of published Content, scenes of a sexual nature, including those involving minors, or scenes of violence, including sexual violence, against people or animals, contains any form of incitement to suicide and/or promotes or promotes incitement to racial, religious, ethnic hatred or hostility, contain information about the use of manufacture and distribution of narcotic drugs, advertising of alcoholic products, propagandizes fascism or ideology of racial superiority, or contains extremist materials, promotes a violation of the rights or legitimate interests of other Users or third parties, or promotes a crime or contains tips/ guidelines/ instructions for its commission, violates other rules of this Agreement, or is prohibited and does not comply with the law. It is also prohibited for Users to use any profanity and obscenity in the name of their own Account or channel when creating, publishing, editing, or otherwise changing them.;

4.4.6. Do not perform any actions or assist third parties in performing actions aimed at disrupting the operation of OnlySport, including, but not limited to: downloading viruses or malicious code; perform actions that may lead to the shutdown of OnlySport, to disruption of the normal operation of OnlySport or the OnlySport Software Equipment, or to deterioration of the external type of Platform;

4.4.7. Not to commit other actions that are illegal, fraudulent, discriminatory or misleading, as well as contrary to the law.

5. Intellectual property

5.1. The OnlySport Administration respects intellectual property rights and therefore requests Users of our online resource to do the same. As a condition of access to and use of the Services, all Users agree that they do not use the Services for the purpose of violating any intellectual property rights. The Administration reserves the right, without notice, at any time and at its discretion, to block access and/or delete the account of any User who violates or allegedly violates copyrights or other intellectual property rights.

5.2. The Administration specifically stipulates that with regard to the protection of intellectual property rights in connection with Content published by Users, the Administration acts as an Information Intermediary (the owner of an information resource on the Internet on which the Content is posted by Internet users and who does not choose the recipient of this information, does not affect the integrity of such transmitted information and due to the specifics of the status of the Information Intermediary and is not responsible for the actions of third parties that violate the current legislation., takes measures to prevent the relevant violations according to the statements of the Copyright Holders.

6. User rights to the posted content

6.1. Only registered Users have the right to post Content on OnlySport.

6.2. The Content created by Users is an object of intellectual property, protected by law, as well as international copyrights, and therefore the Administration does not claim or require Users to grant it any ownership rights to User Content. Nothing in the text of this Agreement should be interpreted as depriving the User of the rights to the Content he creates or restricting them.

6.3. At the same time, the User provides the Administration with a non-exclusive, royalty-free, worldwide license (hereinafter referred to as the "License") with the right to transfer and issue sublicenses for storage, use, distribution, modification, launch, copying, public performance or display, translation of User Content and creation of derivative works on based on it. This License is automatically terminated if the User's account is deleted. After its removal, licenses are terminated, except in cases where otherwise is required for the operation of OnlySport, the use of Content in accordance with the permissions granted before the removal, or required by law. If the User deletes the Content, the OnlySport Administration is also not obligated to delete: a) copies saved by Users for offline viewing; b) copies stored for legal purposes.

7. Content Requirements

7.1. Users are strictly prohibited from downloading any Content that belongs to third parties or the rights to use which have not been provided to such User to the required extent. In this case, the User assumes the obligation to reimburse the Administration for all losses and legal costs incurred by it in connection with claims by third parties that the published Content violates the intellectual property rights of such third parties.

7.2. The Administration does not check and physically cannot check all materials published by Users as part of the Content they create, and therefore the Administration is not responsible for the content of such Content, for its use and/ or its impact on third parties or other Users. The management of OnlySport does not mean that the Administration confirms, supports, guarantees, distributes and/or believes in the information posted within the Content. The user is responsible for their own protection and the protection of their device from viruses and other malware. The Administration does not assume responsibility for harm caused as a result of using OnlySport, its Services and/or Content.

7.3. The Administration has the right at any time to check the User's Content for its compliance with the requirements of this Agreement, as well as for its compliance with current legislation. At the same time, nothing in the text of this Agreement should be interpreted as a direct obligation of the Administration to conduct any independent verification of the Content, except at the request of other Users or third parties.

7.4. In order to comply with the law, the Administration adheres to the rules of law that are prescribed in other regulatory legal acts concerning the requirements in the field of publishing and posting content on the global Internet, and also follows its internal rules of video hosting when publishing content, in connection with which the Administration notifies all Users that potentially unacceptable (“sensitive”) content will be checked on the Platform for compliance with the publication rules. Depending on the nature of the published content, the Administration may restrict the viewing of such content by age category, or mark this content with a warning text confirming the User's consent to continue watching this video, and may also delete this video from OnlySport.

7.5. If you encounter Content that violates the terms of this Agreement or the legitimate rights and interests of Users or third parties, you can send your complaint to the following email address: support@onlysport.app .

8. Account Deletion

8.1. OnlySport has a special warning system for Content that violates the terms of the Agreement. For each subsequent violation, the Administration issues a warning, which entails certain restrictions. In particular, it is possible to delete an account (channel, user content) without the possibility of recovery. If any functions have been disabled due to a warning on the User's channel, then the User will not be able to use them on other channels. If attempts are made to circumvent this restriction, it will be considered a violation of this Agreement. In such cases, the Platform Administration reserves the right to delete this account and block access to all or some of the OnlySport functions.

8.2. The User personally has the right to independently terminate the use of OnlySport at any time by deleting his account.

8.3. If the User violates the terms of this Agreement and/or violates the intellectual property rights of the Administration, other Users or third parties, or commits actions that are illegal, violate the rights and interests of the Administration, other Users or third parties, or undermine the operation of OnlySport or the possibility of using OnlySport by other Users, or the Services or OnlySport are used By the User in such a way that this may entail the legal responsibility of the Administration in the future, including, if required by applicable law or the competent government authority, in this case, the Administration has the right to terminate the User's access to OnlySport and its Services at any time.

8.4. Such termination of access, among other things, also implies the deletion of the User's personal account.

8.5. The User is duly informed that the Administration is not responsible for any damage, losses, lost profits, loss of business or personal reputation caused to the User by deleting or blocking the account and/or inability to access the Platform and its Services.

9. Questions and Answers

9.1. If Users have any questions regarding the terms of this Agreement or the procedure/method of their execution, they can be addressed to the Administration directly by sending an email to: support@support.app .

9.2. The staff and representatives of the Administration undertake to make every possible effort to respond to the request as soon as possible.

10. Responsibility

10.1. The Administration or its representatives are not responsible to the User or any third parties: for any indirect, accidental, unintended damage, including lost profits or lost data, damage to honor, dignity or business reputation caused in connection with the use of the site, services or other materials that the User or others have access to access via the Platform, even if the Administration has warned or indicated the possibility of such damage.; for the actions of other Users, for the content posted by Users, for goods/services provided by third parties or other Users (even if access to them was provided through our OnlySport), to which the User has gained access; in cases expressly provided for by the terms of this Agreement or applicable Law. legislation.

10.2. The Administration's liability for everything related to the use of OnlySport and/or the Services is limited to the extent permitted by applicable law.

10.3. The Agreement and User relations with OnlySport within the framework of the Agreement are regulated in accordance with international law. The parties may apply to the courts to resolve disputes.

11. Advertising placement

11.1. The Administration has the right to post any advertising or marketing materials on OnlySport at a certain time.

11.2. The OnlySport Content may contain links to third-party websites and/or advertising or marketing materials about goods/services provided by such third parties (hereinafter referred to as "Third-Party Advertising"). The Administration assumes no responsibility for the content of third-party Advertisements, as well as for the availability, quality and safety of advertised goods/ services in such advertisements, as well as for any losses, losses or damages incurred or caused to the User as a result of reading such advertisements or using the website. products advertised in third-party advertisements/services.

11.3. In case of access to another website through third-party advertisements posted on OnlySport, the Administration cannot guarantee that such website is safe for the User and/or his computer. Nothing in the text of this Agreement should be interpreted as an assurance, encouragement, recommendation or encouragement of the User to use third-party advertising, visit any third-party sites, as well as try, purchase, use any third-party products/services.

11.4. Issues related to the protection of Users' personal data when using third-party advertising are regulated by the OnlySport Privacy Policy.

12. About our Agreement

12.1. The Administration has the right to review, supplement or amend the terms of this Agreement at a certain time. Such changes are usually not retroactive. The Administration assumes no obligation to notify Users of any upcoming or past changes to the text of the Agreement. By joining the terms of this Agreement, the User also undertakes to periodically review the terms of this Agreement for changes or additions. If, after making changes or additions to the text of the Agreement, the User continues to use the Site, this assumes that he is familiar with the changes or additions and has accepted them in full without any objections.

12.2. An integral part of this Agreement is the Privacy Policy, the Terms of Protection of Intellectual Property Rights, as well as other documents that any User can freely read.

12.3. Access to the Platform and its Services is provided to the User "as is". The Administration does not promise, guarantee, or imply that the Services and OnlySport may or may not meet the User's needs, goals, or expectations, and therefore does not guarantee any specific results or consequences as a result of Users' use of the OnlySport Services.
